5. Analysis Tools und Advertising

Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics uses so-called "cookies". These are text files which are stored on your computer and which enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there.

The storage of Google Analytics cookies and the use of this analysis tool are based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the analysis of user behavior in order to optimize both his website and his advertising. If a corresponding consent has been requested (e.g. consent to the storage of cookies), the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR; the consent can be revoked at any time.

IP Anonymization

We have activated the IP anonymization function on this website. This means that your IP address will be truncated by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area before it is transmitted to the USA. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on the website activities and to provide further services to the website operator in connection with the use of the website and the Internet. The IP address transmitted by your browser within the scope of Google Analytics is not combined with other data from Google.

Browser Plugin

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google by downloading and installing the browser plugin available at the following link:

https://tools.google.com/dlpage/gaoptout?hl=de.

Objection to Data Collection

You can prevent the collection of your data by Google Analytics by clicking on the following link An opt-out cookie will be set to prevent the collection of your information on future visits to this site: Disable Google Analytics.

You can find more information on how Google Analytics handles user data in the Google privacy policy:

https://support.google.com/analytics/answer/6004245?hl=de.

Contract Data Processing

We have concluded a contract with Google for commissioned data processing and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Demographic Characteristics in Google Analytics

This website uses the "demographic features" feature of Google Analytics. This allows reports to be generated that contain information about the age, gender and interests of the site visitors. This data comes from interest-based advertising by Google as well as from visitor data from third parties. This data cannot be assigned to a specific person. You can disable this feature at any time in the ad settings in your Google Account or generally prohibit the collection of your data by Google Analytics as described in the "Opting out of data collection" section.

Google Analytics Remarketing

This website uses the functions of Google Analytics Remarketing in conjunction with the cross-device functions of Google AdWords and Google DoubleClick. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

This feature allows you to link the advertising audiences created with Google Analytics Remarketing to the cross-device capabilities of Google AdWords and Google DoubleClick. In this way, interest-based, personalized advertising messages that have been customized for you on one device (e.g. cell phone) can also be displayed on another of your devices (e.g. tablet or PC), depending on your previous usage and surfing behavior on that device.

If you have given your consent, Google will link your web and app browsing history to your Google Account for this purpose. In this way, the same personalized advertising messages can be displayed on any device you sign in with your Google Account.

To support this feature, Google Analytics collects Google-authenticated user IDs that are temporarily linked to our Google Analytics data to define and create audiences for cross-device advertising.

You can opt-out of cross-device remarketing/targeting permanently by deactivating personalized advertising in your Google Account, following this link: https://www.google.com/settings/ads/onweb/.

The aggregation of the collected data in your Google Account is based solely on your consent, which you can give or withdraw to Google (Art. 6 para. 1 lit. a GDPR). For data collection processes that are not merged into your Google Account (e.g. because you do not have a Google Account or have objected to the merging), the collection of data is based on Art. 6 para. 1 lit. f GDPR. The legitimate interest arises from the fact that the website operator has an interest in the anonymized analysis of website visitors for advertising purposes.

Further information and the data protection regulations can be found in the Google data protection declaration at: https://policies.google.com/technologies/ads?hl=de

Google AdWords and Google Conversion-Tracking

This website uses Google AdWords. AdWords is an online advertising program of Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

In the context of Google AdWords we use the so-called conversion tracking. When you click on an ad placed by Google, a conversion tracking cookie is set. Cookies are small text files that the Internet browser places on the user's computer. These cookies expire after 30 days and are not used to personally identify users. If the user visits certain pages of this website and the cookie has not expired, Google and we can recognize that the user clicked on the ad and was redirected to that page.

Each Google AdWords customer receives a different cookie. The cookies cannot be tracked through the websites of AdWords customers. The information collected through the conversion cookie is used to compile conversion statistics for AdWords customers who have opted in to conversion tracking. Customers are told the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive information that personally identifies users. If you do not wish to participate in tracking, you can opt-out of this use by slightly disabling the Google conversion tracking cookie on your web browser under User Preferences. You will then not be included in the conversion tracking statistics.

The storage of "conversion cookies" is based on Art. 6 para. 1 lit.

More information about Google AdWords and Google Conversion Tracking can be found in Google's privacy policy: https://www.google.de/policies/privacy/.

You can set your browser to inform you about the setting of cookies and to allow cookies only in individual cases, to exclude the acceptance of cookies for certain cases or in general, and to activate the automatic deletion of cookies when closing the browser. If you deactivate cookies, the functionality of this website may be limited.

6. Newsletter

Newsletter Data

If you would like to receive the newsletter offered on the website, we need an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. Further data will not be collected or only on a voluntary basis. We use these data exclusively for sending the requested information and do not pass them on to third parties.

The processing of the data entered in the newsletter registration form is based exclusively on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke your consent to the storage of the data, the e-mail address as well as its use for sending the newsletter at any time, e.g. via the "unsubscribe" link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

After you have been removed from the newsletter distribution list, your e-mail address may be stored by us or the newsletter service provider in a blacklist to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in compliance with the legal requirements when sending newsletters (legitimate interest in the sense of Art. 6 para. 1 lit. f GDPR). The storage in the blacklist is not limited in time.

You can object to the storage if your interests outweigh our legitimate interest.

mailingwork

This website uses the services of mailingwork for sending newsletters. The provider is mailingwork GmbH, Birkenweg 7, D-09569 Oederan OT Memmendorf, Germany. mailingwork is a service that can be used to organize and analyze the distribution of newsletters.

If you enter data for the purpose of receiving the newsletter (e.g. e-mail address), this data will be stored on the mailingwork servers in Germany. With the help of mailingwork we can analyze our newsletter campaigns. When you open an email sent with mailingwork, a file contained in the email (so-called web-beacon) connects to the servers of mailingwork. This way it can be determined whether a newsletter message has been opened and which links have been clicked on. Technical information is also collected (e.g. time of access, IP address, browser type and operating system). This information cannot be assigned to the respective newsletter recipient. It is used exclusively for statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

If you do not want to receive analysis by mailingwork, you must unsubscribe from the newsletter. For this purpose we provide a link in every newsletter message. You can also unsubscribe directly on the website.

The data processing is based on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time by unsubscribing the newsletter. The legality of the data processing operations that have already taken place remains unaffected by the revocation.

The data you provide us with for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers as well as from the servers of mailingwork after you unsubscribe from the newsletter. Data stored for other purposes (e.g. email addresses for the member area) remain unaffected.

After you have been removed from the newsletter distribution list, your email address will be stored in a blacklist by us or mailingwork to prevent future mailings.

Conclusion of a processing contract

We have concluded a so-called order processing contract with mailingwork in which we commit mailingwork to protect the data of our customers and not to pass it on to third parties.

7. Plugins and Tools

Google Tag Manager

We also use Google Tag Manager to manage usage-based advertising services. The Tag Manager tool itself is a cookie-less domain and does not collect any personal information. Rather, the tool triggers other tags that may collect data (see above). If you have disabled it at the domain or cookie level, it will remain disabled for all tracking tags implemented with Google Tag Manager.

Leadpages

This website uses an external service provider for the creation of landing pages. The provider is Leadpages.net: Avenue 81 d/b/a Leadpages Address: 251 N. 1st Ave., Minneapolis, MN USA 55401.

In order to ensure the functionality of the landing pages of this website, the user is redirected to the Leadpages page when clicking on the linked landing pages. The provider of the Leadpages pages automatically collects and stores information in so-called server log files, which the user's browser automatically transmits to Leadpages. This data is not merged with other data sources:

  • E-mail address of the user
  • IP address
  • Time zone
  • User behavior such as page visits, buying behavior, user-defined events

The basis for the data processing is the legitimate interest in the announcement or advertising of different products and services of chemmedia AG according to Art. 6 para. 1 lit.f GDPR, whereby the integration of lead pages is based on a commissioned data processing agreement according to Art. 28 GDPR, which are agreed as EU standard clauses between chemmedia AG and Leadpages.

We offer you the opportunity to apply for a job with us (e.g. by e-mail or by post). In the following we will inform you about the scope, purpose and use of your personal data collected during the application process. We assure you that the collection, processing and use of your data will be in accordance with the applicable data protection laws and all other legal requirements and that your data will be treated in strict confidence.

Scope and Purpose of Data Collection

If you send us an application, we will process your associated personal data (e.g. contact and communication data, application documents, notes taken during job interviews, etc.) to the extent that this is necessary to make a decision on the establishment of an employment relationship. The legal basis for this is § 26 BDSG-neu under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b GDPR (general contract initiation) and - if you have given your consent - Art. 6 para. 1 lit. a GDPR. Consent can be revoked at any time. Within our company, your personal data will only be passed on to persons involved in the processing of your application.

If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of § 26 BDSG-neu and Art. 6 para. 1 lit. b GDPR for the purpose of carrying out the employment relationship.

Storage Period of the Data

If we are unable to offer you a job, if you reject a job offer or if we withdraw your application, we reserve the right to keep the data you have submitted with us for up to 6 months from the end of the application procedure (rejection or withdrawal of the application) on the basis of our legitimate interests (Art. 6 para. 1 letter f GDPR). Afterwards, the data will be deleted and the physical application documents destroyed. The storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g. due to an imminent or pending legal dispute), the data will only be deleted when the purpose for further storage no longer applies.

A longer storage period can also take place if you have given your consent (Art. 6 para. 1 lit. a GDPR) or if legal storage obligations prevent deletion.
